These Terms and Conditions (”Agreement”) govern your use of the XPr Ensue mobile application (”App”) provided by Xperience Health Sverige AB (”Xperience Health”). By accessing and using the App, you agree to comply with these Terms and Conditions. Please read this Agreement carefully.

1. Acceptance of Terms
By downloading, installing, or using the XPr Ensue App, you acknowledge that you have read, understood, and agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree to these terms, you may not access or use the App.

2. App Description and Functionality
XPr Ensue is a mobile application designed to log physical activity metrics, such as steps per minute and active minutes per day. The App utilizes the accelerometer on your mobile device to collect this data and does not use GPS for logging physical activity.
The App also offers AI-powered coaching services built on GPT technology. This advanced AI provides dynamic and personalized coaching tailored to the user’s needs.
The App offers AI-generated training exercise regimes built on GPT technology. These regimes consider users’ needs, preferences, goals, and possible obstacles. Users can choose from 11 predefined purposes and answer questions necessary for personalized regime generation.

3. Registration and User Information
You can register for the App through multiple methods, including:
Google
Apple
Manual registration using an email address.
By registering for the App, you consent to the collection and use of the information provided during registration. This information may be used for purposes such as:
Contacting you for marketing activities.
Gathering feedback to improve the App and its services.
Other comparable communication purposes.
Data Accuracy
You are responsible for providing accurate and current registration data. Failure to provide accurate information may result in the suspension or termination of your account.
Account Security
You are responsible for maintaining the confidentiality of your account credentials. Xperience Health Sverige AB shall not be held liable for any unauthorized use of your account.

4. User Responsibility and Behavior
You are solely responsible for your use of the App and any information you provide. By using the App, you agree to:
a. Comply with all applicable laws, regulations, and these Terms and Conditions.
b. Provide accurate and complete information during registration and keep your account credentials secure.
c. Use the App for personal, non-commercial purposes only and not for any illegal or unauthorized purpose.
d. Refrain from engaging in any activity that may disrupt or interfere with the App’s functioning or security.
Medical Disclaimer
The App is not a substitute for professional medical advice. Before using the App, consult your physician if you have any medical conditions, including but not limited to:
Heart conditions (e.g., heart failure, valve disease, hypertension).
Skeletal issues (e.g., osteoporosis, herniated disc, osteoarthritis).

5. Coaching Services
XPr Ensue offers subscription-based coaching services powered by advanced AI technology built on GPT.
a. Payment
You agree to pay the applicable fees for the coaching subscription as outlined in the App.
Payment methods are subject to the terms of the respective payment processor (e.g., Google Pay, Apple Pay).
b. Subscription Terms
The coaching subscription may be cancelled at any time through the App’s designated cancellation process.
No refunds will be provided for any unused portion of the subscription.
c. Accuracy of Information
The coaching services rely on the information you provide. You are responsible for ensuring that all inputted data is accurate and up to date.
d. Limitations
Coaching services provide general physical activity guidance and are not a substitute for professional healthcare advice.
Xperience Health Sverige AB assumes no liability for outcomes based on coaching recommendations.

6. Privacy
The collection, storage, and use of personal information are governed by the XPr Ensue Privacy Policy. By using the App, you consent to the processing of your personal data in accordance with the Privacy Policy.

7. Intellectual Property
All intellectual property rights in the App, including but not limited to trademarks, logos, software, and AI technology, are owned by Xperience Health Sverige AB or its licensors. Unauthorized use, reproduction, or modification of these materials is prohibited.

8. Disclaimer of Warranties
The App is provided ”as is” and ”as available” without any warranties, express or implied, including but not limited to:
Merchantability
Fitness for a particular purpose
Non-infringement

9. Limitation of Liability
To the fullest extent permitted by law, Xperience Health Sverige AB shall not be liable for:
Indirect, incidental, or consequential damages.
Loss of data, revenue, or profits.
Any damages resulting from the use or inability to use the App.

10. Modifications to the Agreement
Xperience Health Sverige AB reserves the right to modify this Agreement at any time. Notice of changes will be provided within the App. Continued use of the App constitutes acceptance of these changes.

11. Governing Law and Jurisdiction
This Agreement shall be governed by and construed under the laws of Sweden. Disputes shall be resolved exclusively in the courts of Sweden.

12. Entire Agreement
This Agreement constitutes the entire agreement between you and Xperience Health Sverige AB regarding the App and supersedes prior agreements.
